Welcome to the Breath Buddy website. We provide all our services to you under the terms of this agreement, which include notices, terms, and conditions (the "Agreement"). These terms and conditions ("Terms and Conditions") apply to any Breath Buddy websites, applications, services, and products ("Services" or each a "Service") that include a link to these Terms and Conditions and are delivered by Breath Buddy anywhere in the world ("Breath Buddy", "we", "us" or "our"). Furthermore, when you use any of our services (for example, Customer Reviews), you will be subject to the appropriate rules, guidelines, policies, terms, and conditions, which are included in this Agreement by reference. At any moment, we retain the right to modify this Site and these terms and conditions. Please read this agreement carefully before proceeding, as accessing, browsing, or otherwise using the site indicates your agreement to all of the terms and conditions in this agreement. Please do not use the Services if you do not agree to these Terms and Conditions.

Using our services

Unless otherwise stated herein, all content contained within the Services, including text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, videos, audio, images, applications, programs, computer code, and other information (collectively, the "Content"), is owned by Breath Buddy and is protected by copyright, registered trademarks, and other laws.

You represent and warrant that you are at least 18 years old or under the supervision of a parent or guardian when visiting the Site.

We hereby grant you a limited, revocable, non-exclusive license to access and use the Site by displaying it on your internet browser only to shop for personal items sold on the Site and not for any commercial use or use on behalf of any third party, unless we expressly permit it in advance. Without giving you notice; any breach of this Agreement will result in the cancellation of the permission issued in this paragraph.

Unless we have expressly permitted you to do so in writing, you may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, change, reverse-engineer, disassemble, decompile, or otherwise exploit this Site or any portion of it. You may not use any of the information offered on the Site for commercial purposes or utilize the Site for the profit of another business unless we expressly permit it in advance. We have the right to reject service, terminate accounts, and/or cancel purchases at any time, for any reason, including, but not limited to, if we determine that the behaviour of customers is unlawful or harmful to our interests.

To permit you to access and use some parts of our Site, we may offer you a password and account id. You shall be deemed allowed to access and use the Site under the terms and conditions of this Agreement each time you use a password or id, and we will have no obligation to examine the authorization or source of any such access or use of the Site.

You will be solely responsible for all access to and use of this site by anyone using the password and identification originally assigned to you, whether or not such access to and use of this site was authorized by you, including without limitation, all communications and transmissions, and all obligation. You are completely responsible for keeping the password and identification supplied to you secure and confidential. Any unauthorized use of your password or identification, as well as any other breach or potential violation of this Site's security, must be reported to us immediately.

REVIEWS / Q&A CONTENT

Except as otherwise provided in this Agreement or on the Site, anything you submit or post to the Site and/or provide us with, including without limitation, ideas, know-how, techniques, questions, reviews, comments, and suggestions (collectively, "Submissions"), is and will be treated as non-confidential and non-proprietary, and we will have the royalty-free, worldwide, perpetual, irrevocable, and transferable right to use, copy, distribute, display, and publish, per your Submissions. All Submissions become our sole and exclusive property upon submission and will not be returned to you.

When you post comments or reviews to the Site, you also grant us the right to use the name that you submit with any review, comment, or other Content, if any, in connection with such review, remark, or other content, in addition to the rights applicable to any Submission. You should not use a false email address, impersonate someone else, or otherwise mislead us or third parties about the origin of any Submissions or Content. For any reason, we may remove or alter any Submissions (including comments or reviews).

INTELLECTUAL PROPERTY

Breath Buddy owns all text, graphics, button icons, pictures, audio clips, and software (collectively, "Content"). Breath Buddy owns the collection, arrangement, and assembly of all Content on this Site (the "Compilation"). Copyright laws in the United States and around the world protect the Content, Compilation, and Software. 

POLICY ON PRIVACY

TERMINATION AND ITS CONSEQUENCES

We may, without prior notice to you, immediately terminate the Agreement or revoke any or all of your rights granted under this Agreement, in addition to any other legal or equitable remedies. 

If this Agreement is terminated, you must immediately cease all access to and use of the Site, and we will immediately revoke all passwords and account identification issued to you, as well as deny your access to and use of the Site in whole or in part, in addition to any other legal or equitable remedies. 

Any termination of this Agreement will not affect the parties' respective rights and obligations (including, but not limited to, payment obligations) arising before the termination date.

ACCESS FROM AROUND THE WORLD

Access to this Site is possible from countries other than the United States. This Site may include products or references to products that are only available in the United States. Any references to such products do not suggest that they will be made accessible outside of the United States. You are responsible for complying with your local laws and regulations if you access and use this Site from outside the United States.

TYPOGRAPHICAL MISTAKES

If a product is listed at an inaccurate price or with wrong information as a result of a typographical error or an error in pricing or product information received from our suppliers, we have the right to refuse or cancel any orders placed for that product. 

Whether or not the order has been confirmed and your credit card charged, we have the right to refuse or cancel any such orders. 

If your credit card has already been charged for the purchase and you cancel it, we will issue a credit to your credit card account in the amount of the charge as soon as possible.

This site may contain links to third-party websites that are owned and maintained on the Internet. You agree that we are not responsible for the operation of any such site, or the content found on or through it.

COPYRIGHT COMPLAINTS

Others' intellectual property is respected by us. Please notify us by contacting us about your copyright claim if you believe your work has been copied in a way that constitutes copyright infringement.

REMEDIES

You agree that a legal remedy for any actual or threatened breach of this Agreement would be insufficient and that we shall be entitled to specific performance or injunctive relief, or both, in addition to any damages that we may be legally entitled to recover, as well as reasonable dispute resolution expenses, including, without limitation, attorneys' fees.

No claim or remedy of ours, whether at law or in equity, shall be exclusive of any other, including but not limited to damages, injunctive relief, attorneys' fees, and expenses.

We will not be obligated to grant any similar, future, or another waiver if we waive any of our rights or remedies under these terms and conditions.

SEVERABILITY

If any of these provisions is found to be invalid, void, or unenforceable for any reason, that condition will be treated as a separate condition, and the validity and enforceability of the remaining provisions will not be affected.

Breath Buddy maintains the right, in its sole discretion, to update, amend, add, or remove sections of these Terms and Conditions at any time and without notice.
